Job Summary:
With an expanded mission and authority including oversight of the swap markets, the CFTC continues to protect the American public by promoting market integrity, transparency and preventing and prosecuting fraud, manipulation and other abuse in the futures and options markets. Please visit http://www.cftc.gov/ to learn more about the CFTC. This position is located in the General Law Branch of the Office of General Counsel (OGC). The Office of General Counsel (OGC) is the principal legal adviser to the Commission and to leadership in other divisions within the agency on a variety of issues involving the Commodity Exchange Act (CEA), rules promulgated thereunder, and other federal statutes having implications for the work and administration of the agency, such as the Administrative Procedure Act, bankruptcy laws, federal securities and banking laws, and the laws governing appropriations, acquisitions, employment, and labor relations. The OGC represents the CFTC in civil litigation before U.S. District Courts, U.S. Courts of Appeals, various administrative tribunals, and in arbitration, in cases involving those areas of law. The OGCs General Law Branch serves as the principal advisor to the General Counsel and the Commission on the varied legal issues related to the administration and management of the Commission, areas which are governed by both the CEA and statutes and regulations of Government- and agency-wide applicability. Through OGCs General Law Branch, staff provide oral advice and written legal opinions to the General Counsel, Chairman, Commissioners, and operating divisions concerning such complex legal areas as appropriations law, the Ethics in Government Act, the Freedom of Information Act (FOIA), information and privacy law, intellectual property law, procurement law, the Federal Advisory Committee Act (FACA), the Sunshine Act, equal employment opportunity law, civil rights law, labor law, labor relations, and employee relations. The General Law Branch also advises and makes recommendations on the interpretation of applicable laws and provide guidance to the Chairman and the Office of the Executive Director on budget, debt collection, interagency agreements, fee structures, and other fiscal policy issues. In addition, the General Law Branch assists the Office of the Executive Director and operating divisions with the review of agency policies and procedures. The Ethics, FOIA and FACA programs are also housed within the General Law Branch.
